一、簽訂三方協(xié)議
大學生離開學校,進入職場,首先要簽訂一個三方協(xié)定,進入公司以后,要與用工單位簽訂勞動合同,受到勞動法的保護,遇到問題,學會拿起法律武器,保護自己。
三方是指學校,企業(yè),畢業(yè)生三方。三方協(xié)議是《全國普通高等學校畢業(yè)生就業(yè)協(xié)議書》的簡稱,它是明確三方在畢業(yè)生就業(yè)工作中的權利和義務的書面表現(xiàn)形式,能解決應屆畢業(yè)生戶籍、檔案、保險、公積金等一系列相關問題。協(xié)議在畢業(yè)生到單位報到、用人單位正式接收后自行終止。
二、就業(yè)協(xié)議不能取代勞動合同
三方協(xié)議簽訂后不是完事大吉,還要與企業(yè)簽訂勞動合同。
勞動保障部門指出:就業(yè)協(xié)議和勞動合同是兩個不同的概念,單位一旦和求職者確立了勞動關系,就應依法簽訂正式的勞動合同;應當訂立勞動合同而未訂立的,勞動者可以隨時終止勞動關系。
